SSUK MEMBERSHIP TERMS AND CONDITIONS
“The Club” or “We” shall mean SSUK Car Club Ltd (Supercar Society UK)
“The Members” or “You” shall mean verified members of The Club.
“Club Events” shall mean the exclusive events run by The Club.
“Club Membership” shall mean the membership afforded to Club Members upon payment of the mandatory fees.
THE CLUB AGREES TO:
– Keep The Members updated on Club Events via email, social media and members only Whatsapp groups.
– Withhold the right to terminate your Club Membership with immediate effect on the evidence of dangerous, reckless, anti-social or inconsiderate driving.
– Withhold the right to terminate your Club Membership due to actions by a Club Member during or outside of Club Events deemed unacceptable, offensive or outside the spirit of The Club.
– Withhold the right to terminate your Club Membership following complaints from multiple members during a Club Event.
– Issue the Club Member with a written warning in relation to dealing with the above grievances if termination is too extreme. Cause for a second warning will result in termination of Club Membership.
– Withhold the right to cancel any membership if The Club believes that continued Club Membership is not in the best interest of The Club or The Members.
– Withhold the right to cancel any membership as a result of a members’ involvement in starting up, helping with or assisting in the creation of a new or existing car club, or planning, organising or inviting Club Members to similar events or trips that are not officially endorsed by The Club.
– Withhold the right to cancel Club Events due to poor weather conditions, low registration quantity or unforeseen circumstances.
– Reserve the right to amend these terms and conditions without prior notice.
THE MEMBER AGREES TO:
– Read all joining criteria/terms and conditions prior to registering for membership.
– Fill out the online application form in full and check-mark the relative box to acknowledge reading these Terms and Conditions.
– The Club Membership term of a minimum of 12 months, commencing from the date of successful registration & payment.
– Club Membership and this Agreement are personal to you and may not be assigned to anyone else.
– Club Membership, once paid by the Member, is non-refundable.
– Should The Club terminate your Club Membership you will not be issued with a refund and will no longer be entitled to access members only groups or attend Club Events.
– Pay where applicable for Club Events and Road Trips – this will be clearly stated during event registration. Road Trips will be run by SSUK Car Club Ltd and a non-refundable deposit must be paid to book your space. SSUK Car Club Ltd is not currently VAT registered. – Keep The Club updated with your details. Please inform us by email if you change your email or postal address.
– Keep timings and locations of the Club Events private and off any other public forums and websites.
– Take suitable care whilst on Club Events and to abide by local driving laws and speed limits.
– Show respect towards Club Members and their cars during Club Events.
– Maintain a considerate level of driving towards other Club Members and the general public. Evidence of dangerous, reckless, anti-social or inconsiderate driving will lead to The Club issuing a written warning or terminating Club Membership.
– The club does not condone the exceeding local speed limits. All speed limits must be adhered to at all times, especially in towns, villages and built-up areas. Additionally, in rural areas covered by the national speed limit, our members are encouraged to respect local residents and other road users and by reducing their speed and keeping noise limits to a minimum when passing homes & farms and when meeting vehicles travelling in the opposite direction.
– When attending our Club Events, you do so at your own risk and The Club accepts no responsibility for any damage to any cars or persons attending the event.
– The associated dangers of travelling on public highways and therefore the inherent risk in taking part in road-based events such as those hosted by The Club include; risk of accident, risk of injury or risk of death. Whilst we strive to ensure our events are as safe as possible we will not be held responsible nor do we have any control over the driving of our participants or other road users and The Club accepts no responsibility for these risks. It is entirely The Members responsibility to ensure they are physically and mentally prepared.
– There will be no reward from The Club for those who arrive at event destinations or meeting points first. Club Events are not timed and are not designed to be approached as a race.
– The club does not condone members informing other members of hazards via radios whilst on Club Events. You do so entirely at your own risk and use your own judgement.
– Whilst we recommend the use of walkie talkies in order to communicate to fellow member’s vehicles, you should never use them whilst in control of your vehicle, and it should be the sole responsibility of your passenger(s) to use them. Whilst the walkie talkies are useful for informing members of certain information, under no circumstances should they be used to provoke overtaking under dangerous circumstances. The information passed on by walkie talkie should never be relied on and doing so poses an enormous risk. The Club accepts no liability for accidents associated with this.
– Pay all fines, penalty charges or costs connected with the vehicle whilst on Club Events.
– Not to pose as a servant or agent of the Club or Company.
– Give The Club permission to use photos of your car on our website, social media and for promotional purposes unless otherwise stated. The Club retains the right to allow duplication and publication of any associated images unless The Member expressly requests otherwise by emailing social@supercarsociety.co.uk prior to the relevant event start date.
– Not to promote rival events/clubs during Club Events or to Club Members, nor to plan, organise or invite Club Members to similar events or trips that are not officially endorsed by The Club. We withhold the right to terminate your membership with immediate effect if you do so.
– The act of a member starting up, helping with, or assisting in the creation of a new or existing car club, or any event that emulates that of The Club, is strictly forbidden without explicit written consent. Any such activity should be declared to our club and may result in termination of your membership due to conflict of interest.
– All unauthorised advertising or soliciting on The Club forum or at Club Events will be removed without explanation and without notice.
ROAD TRIP BOOKINGS & PAYMENTS
– All Road Trip events are offered subject to availability and on a first come first served basis.
– There shall be no formal and binding contract between The Club and The Member until the requested deposit (or where appropriate the full amount due) has been received by The Club. Provisional bookings will only be confirmed once the deposit payment is received in full.
– Failure to pay the balance of any deposit (or where appropriate the full amount due) as requested will entitle The Club to cancel the booking without further advance notice to The Member.
– All Road Trip deposits are non-refundable.
– All fees must be paid no later than 28 days before the start of the event. If The Member chooses to cancel their place less than 2 months before the start of the trip, 50% of the full trip fee must still be paid, and if cancelled less than 1 month before the start of the trip the full fee must still be paid.
– We reserve the right to cancel or refuse any bookings at our sole discretion.
SSUK ROAD TRIPS / DRIVE OUTS TERMS & CONDITIONS
GENERAL INFORMATION
– You must understand the risks involved in participating in this type of event. It is an adventure and can therefore be dangerous. You are responsible for everything you do and we accept NO responsibility whatsoever.
– An SSUK Road Trip/SSUK Drive Out (the ‘Event’) is NOT A RACE or time trial. Participants must not compete at any level with each other or other road users. Anyone found doing so will be removed immediately from the Event and no refund will be issued. You must drive with care and attention for your own safety and the safety of others at all times.
– The Event is not a guided tour – it is a navigational road trip or drive out where you will be given a route/finish point and be expected to navigate to it with your own map/Sat Nav system.
– Where a Road Trip Booking is made all persons booked under the lead name of the booking agree to the Terms & Conditions set out here upon payment of a deposit.
FEES
– Deposits and fees are non-refundable. The entry fee does not include any personal expenses during the Event, such as fuel, tolls, any food or drink not included in the event description, fines, repair costs or any other expenses of any kind.
– All fees must be paid no later than 28 days before the start of the event. If The Member chooses to cancel their place less than 2 months before the start of the trip, 50% of the full trip fee must still be paid, and if cancelled less than 1 month before the start of the trip the full fee must still be paid.
– If, for any reason, you decide to withdraw either before or during the Event, your fee is neither transferable nor refundable. Please note, this policy also applies if you develop symptoms of Covid-19, are diagnosed with Covid-19, or are asked to self-isolate either before or during the Event. We advise you to take out suitable insurance if you think this will be a problem.
– The Event organisers reserve the right to refuse entry to the Event.
DOCUMENTS
a) Driving Licence – all drivers must hold a valid full UK driving licence
b) Vehicle insurance – for all drivers
c) MOT certificate – as the condition of a vehicle may deteriorate within the period of an MOT, it is your responsibility to ensure that your vehicle is in a roadworthy condition for the event.
– It is the sole responsibility of the participants to ensure that their documents are in order. They must be valid from the beginning up to, and including, the last day of the Event. You will be required to sign to this effect at the Event launch. Failure to sign the registration form will result in disqualification from the Event without refund.
– You cannot participate in any other vehicle than the one registered.
DECALS
– By paying the entry fee for road trips, you agree to have SSUK and all official Event sponsors’ stickers placed on your vehicle at all times during the Event. All stickers are non-permanent, are easy to remove and will not leave any damage to your vehicle. The Event organisers are therefore not responsible for any claims of damage to your vehicle as a result of applying or removing such stickers.
LOCAL LAW
– All participants must drive safely and at all times obey the specific regulations for each country visited. This includes (but is not limited to) speed regulations, highway laws, vehicle safety laws and laws relating to the possession or use of alcohol or drugs.
– It is up to you to ensure that you are fully up to date with the driving requirements for each country you visit.
ACCOMMODATION
– For all road trip bookings, accommodation will be either a twin or double room. The Event organisers will endeavour to provide the requested room type (either twin or double) but cannot guarantee this. A credit card must be provided for each room as a security deposit when checking in. It will be charged at check out for any costs (such as food and drinks) or damages.
CODE OF CONDUCT
– All participants must conduct themselves responsibly and in an appropriate manner at all times. You must not consume alcohol whilst driving, drive whilst under the influence of alcohol (or any other intoxicating substance) or drive if your ability to do so safely is compromised by illness, lack of adequate rest, or any other condition. Any illegal behaviour will result in the cancellation of your participation without refund.
RESPONSIBILITY
– The Event organisers accept no responsibility for the consequences of you being refused entrance into or exit out of any country, city, venue or premises during the Event. Any additional costs incurred are solely the participants’ responsibility.
REFUNDS
– If you fail to complete any part of a road trip or become unable to continue at any stage of the Event, you will not be entitled to a refund.
CHANGES/CANCELLATION
– The Event organisers reserve the right to either change the Event schedule/description or cancel the Event at any time.
IMAGE RIGHTS
– All participants consent to be photographed and to be included in any filming of the Event. You consent to the use of your name, image, likeness, voice and biographical material in connection with any and all footage, publicity and related promotional material. Participants are only entitled to take photographs and film footage of the Event for non-commercial purposes.
BRANDING
– You are not permitted to use SSUK logos or branding under any circumstance other than placing stickers on your vehicle. This includes any printed material or websites.
INTELLECTUAL PROPERTY RIGHTS INCLUDING COPYRIGHT
a) The names, images and logos identifying SSUK (Supercar Society UK) and all associated companies or third parties and any products and services are proprietary marks of these parties. Nothing in the Terms shall be construed as conferring to you any licence or right under any intellectual property right of any of the above parties unless expressly stated otherwise.
b) All copyright, trade marks and other intellectual property rights in the Website (including the design, arrangement and look and feel) and all material, software or content supplied as part of the Website, shall remain at all times our property or the property of our licensors and is protected by intellectual property law.
FORCE MAJEURE
– The Event organisers cannot accept liability or refund monies if the Event has to be amended or cancelled due to any circumstances outside our control or that we could not foresee or avoid. Such as (but not limited to) war, threat of war, riot or civil unrest, terrorist activity, industrial disputes, natural disasters, epidemic diseases, adverse weather conditions, or traffic delays. Neither can we be held responsible if certain attractions change their opening times or are closed.
TERMS AND CONDITIONS CHANGES
– The Event organisers reserve the right to change these terms and conditions at any time. Participants will be notified of the changes and will be deemed to have accepted the amended terms and conditions by participating in the Event.
INDEMNITY
– You will indemnify the Event organisers, its officers, directors, employees, consultants, agents and sponsors against any and all claims, lawsuits and causes of action brought against them by any third party as a result of your action or participation in the Event, including without limitation, your violation of any laws or regulations or your breach of these Terms and Conditions of entry.
VIOLATION OF TERMS
– If any participants violate any of the above terms and conditions or refuse to follow the instructions given prior or during the Event by the Event organisers, you may be prohibited from any or further participation in the Event.
LAW
– These terms and conditions and your participation in the Event are governed by English law and you submit to the jurisdiction of the Courts of England.
